Overview

The terms “we”, “us”, and “our” refer to Heap a trading name of GreenZone Design Ltd. The term “Site” refers to paulhensey.com. The terms “user”, “you” and “your” refer to site visitors, customers, subscribers and any other users of the site.

Service

Heap is a subscription members site for the download of construction detail drawings along with additional content for exclusive subscriber use only.
Use of the site, including all materials presented and all online services provided by us, is subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, customers, and all other users of the site.
By using this site, you agree to these Terms and Conditions, without modification, and acknowledge reading them.
We reserve the right to substitute services equal to or comparable to the services listed if the need arises, without prior notice.

The use of drawings, details and technical articles

Heap and the images and files contained within, unless otherwise stated (drawings, details and 3D components), are copyrighted, and may not be reproduced without our permission.
The drawings and details are not to be used by manufacturers to demonstrate the use of their own products, or for use in other literature, marketing documents and other associated materials. Manufacturers interested in using or altering our drawings or details for their own use must contact us directly.
All details and drawings (in all formats) available on Heap are copyrighted. They are for personal and commercial use in construction projects by the subscriber/member only. They may not be published on any website, resold, repurposed or distributed beyond the uses outlined here.
We offer no assurance or guarantee of Building Regulations approval or compliance to any industry standards using these generic details and drawings. These generic details and drawings should not be considered as industry standard, and further advice should always be sought when preparing or altering construction drawings for specific projects.
Whilst every effort has been made to ensure the accuracy of the information provided within Heap, we make no guarantee in respect to errors or omissions.
The details and drawings must be regarded as a starting point for developing your own detail relevant to your specific project and needs.
We assume no legal liability or responsibility for loss or damage resulting from the use of information contained within the Heap website.
We reserve the right to update or change information on the site at any time without prior notice.
Landscape construction drawings should be prepared by a suitably qualified and experienced person, who holds the appropriate insurances.

Access to the library is provided for the purpose of selecting and downloading individual details relevant to specific projects. Systematic or bulk downloading of the library or significant portions of it is not permitted.

Software Requirements

The details and drawings are saved in the following file versions:
SketchUp version 2023+
SketchUp Layout 2023+
PDF File
DWG File

Please note :
Vectorworks 2023+ will open dwg and SketchUp files
Revit 2023+ will open dwg and SketchUp files
It is your responsibility to ensure you have the appropriate software to open the files.

Subscription Accounts

Payment is for one year subscription and will be automatically renewed via Paypal on the anniversary. If you wish to cancel your renewal please do so via your Paypal account.  It is your responsibility to make sure we hold your current email address and that it is checked regularly. Any changes to your email or Heap account details must be notified by email to heapadmin@paulhensey.com. We advise adding our email address heapadmin@paulhensey.com to your contacts so that it does not get filtered into Spam/Junk folders.

Sole User Subscription Licence

Login details are valid only for the subscription/member licence holder whose name and email are associated with the registration. Login details must not be distributed, published or forwarded for use by third parties.
If we suspect misuse of login information, we have the right to terminate your account immediately without refund of subscription paid. Any member once terminated or suspended forfeits the right to use any detail or component of Heap with immediate effect.

Practice / Multi User Licence 

A multi user Practice licence is available by special request. It is granted at the discretion of the directors and the Practice owner/director must provide the individual users details as unique logins will be required for each seat. It is the Practice owners/directors responsibility to update Heap with any change of users and to ensure that logins/accounts are not shared outside of the member Practice. 

Intellectual Property Rights to our Materials

We claim Intellectual Property Rights over the material we supply within Heap Landscapes Detailed. We retain copyright and any other rights we may rightfully hold in any content that we submit through the Site or its Service. Content we submit to Heap Landscapes Detailed remains ours to the extent that you have any legal claims therein. You agree to hold Heap Landscapes Detailed (and Paul Hensey) harmless from and against all claims, liabilities, and expenses arising out of any potential or actual misuse of copyright or trademark misappropriation or infringement. By posting material on the Site, we grant you a license to use the material for your own projects; however the subscriber must satisfy themselves that the material is fit for purpose as we do not accept any liability for misuse.

Pricing

Prices advertised are exclusive VAT. VAT may be added at checkout dependent on customer location.
Prices are subject to change. Members will be notified of any price increases in advance, and will be given the opportunity to cancel their subscription prior to the price change if desired.

Refusal of service

The Services are offered subject to your acceptance of our Ts & C’s. We reserve the right to refuse service to any person or entity, without the obligation to state reason for doing so. No subscription is deemed accepted by us until payment has been processed. We may at any time change or discontinue any feature of the Site or Service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment.
We reserve the right to remove the accounts held by any individuals representing companies that offer a similar or directly competing Service. Any member/s found to be in breach of the Terms of Use will have their account immediately suspended/cancelled and will forfeit their rights to refund or partial refund of paid fees. Once suspended or terminated the member forfeits the right to use any detail or component within Heap.

Educational Institutions

Heap Landscapes Detailed is not currently available to educational institutions. Subscriptions must not be purchased for the use of multiple users, or access to the contents held within the site for use by multiple users. Please contact us to discuss subscription options for educational institutions.

Cancellation of Subscription

Subscription is automatically renewed on an annual basis. You can cancel your membership at any time during the year. Once subscribed to Heap, should you be unhappy with the service and wish to cancel within the first 14 days you will be eligible for a refund only if you have downloaded no more than 5 items. Refunds are subject to the following terms; if no content is downloaded a refund of the subscription fee less an admin fee of £50, if 1-5 items are downloaded then a refund of the subscription fee less £25 per item downloaded and admin fee of £50. If you cancel after the 14 days but before your renewal date, no refunds will be made for any subscription fees already paid, and you will retain access to the site until the end of your annual payment term.
For registered users, if you cancel your subscription, we will retain your registration information should you wish to re-register for our service and access your account information. On request, we can delete your account information and only retain minimal details for legal reasons, including payment transactions for tax purposes.
It is your responsibility to ensure that you cancel your account in good time should you no longer require the service.

Changed Terms

We may at any time amend these Terms and Conditions. Such amendments are effective immediately upon notice to you by us adding the new Terms and Conditions on this Site. Any use of the Site or Service by you after being notified means you accept these amendments. We reserve the right to update any area of our Site and Service, including these Terms and Conditions, at any time.

Service Access

While we endeavour to ensure that this website is normally available 24 hours a day, we will not be liable if for any reason this website is unavailable at any time or for any period. We will not be liable for any users browser issues and recommend using Chrome, Safari or Firefox when accessing the site.
Access to this website may be suspended temporarily and without notice in the case of system failure, maintenance and repair, misuse by user, or for reasons beyond our control. Any user deemed to be “data mining”, “data stripping” or downloading high volumes/above average volumes of content will be deemed to have breached the terms of use and have their account access immediately blocked and cancelled and will forfeit the right to use any details or components of Heap.

Download Limits and Fair Use

Heap membership provides access to a wide range of construction details, drawings and models intended to support the design and development of individual projects.

To protect our intellectual property and ensure fair access for all members, download limits may be applied to subscription accounts. These limits are designed to prevent excessive downloading, automated data extraction, or the bulk copying of content from the site.

Members must not attempt to bypass or circumvent these download limits by any means, including but not limited to the use of automated tools, scripts, scraping software, shared login credentials, or multiple accounts.

Downloading unusually high volumes of content, systematic downloading of the library, or any activity that suggests copying or redistribution of the content outside the intended use of the service will be considered a breach of these Terms.

Where we reasonably suspect misuse, excessive downloading, data mining, or redistribution of content, we reserve the right to:

  • temporarily suspend or permanently terminate the member’s account

  • restrict access to downloads or specific areas of the site

  • cancel the subscription without refund

Termination of an account for misuse will result in the immediate loss of access to the Heap website and all associated resources.
